English summary: To take precautions against economic risk of a patient can be of vital significance to the parties involved. Statutory health insurance is therefore a decisive component of German social security, which arose at the end of the nineteenth century as workers insurance. The cause for the insurance of these persons was their need for protection because they were not financially capable of independently insuring themselves against the eventuality of sickness. Over the course of time, the statutory health insurance was broadened to insure various groups of people, and the modern working world has appeared to be increasingly complex. Thus, next to the classical standard employment a wide range of different configurations are found in reality and moreover, the social distinctions between dependent and independent working populations have become noticeably smaller over the last several decades. These sets of conditions make it difficult to determine which persons are appropriately assigned to the system of health insurance. This current work considers the subject of who is insured in the modern German system of statutory health insurance system, under what conditions, and on what basis. On account of a detailed reappraisal of individual procedures for determining status of the Federal Social Security Code and the relevant special laws, the questions are answered, whether there is a principle, which determines the assignment of a person to the statutory health insurance and whether the management system is capable of providing an appropriate legal solution to issues that arise in the real working world. German description: Die Vorsorge gegen das wirtschaftliche Risiko einer Erkrankung kann fur den Betroffenen von existenzieller Bedeutung sein. Die gesetzliche Krankenversicherung ist daher ein entscheidender Bestandteil des deutschen Sozialversicherungsrechts. Sie entstand gegen Ende des 19. Jahrhunderts als "Arbeiterversicherung". Anlass fur die Versicherung dieser Personen war deren Schutzbedurftigkeit, da sie in finanzieller Hinsicht nicht eigenstandig in der Lage waren, sich gegen Falle der Erkrankung abzusichern. Im Laufe der Zeit wurde der in der GKV versicherte Personenkreis bestandig erweitert. Daneben zeigt sich die heutige Erwerbswelt zunehmend vielgestaltiger. So ist neben dem "klassischen Normalarbeitsverhaltnis" eine Vielzahl anderer Konstellationen in der Realitat anzutreffen. Zudem sind auch die sozialen Unterschiede zwischen unselbstandigen und selbstandigen Erwerbstatigen in den letzten Jahrzehnten merklich geringer geworden. Aufgrund dieser Umstande ist es nicht einfach, zu bestimmen, welche Personen dem System der gesetzlichen Krankenversicherung zuzuordnen sind. Die vorliegende Arbeit widmet sich dem Thema, wer in der modernen gesetzlichen Krankenversicherung unter welchen Voraussetzungen und aus welchem Grund versichert ist. Anhand einer detaillierten Aufarbeitung der einzelnen Statusbestimmungsnormen des SGB V und der einschlagigen Sondergesetze werden dabei insbesondere die Fragen beantwortet, ob es einen Leitgedanken gibt, der uber die Zuordnung einer Person zur GKV entscheidet und ob das Regelungssystem in der Lage ist, die in der realen Erwerbswelt auftretenden Sachverhalte einer angemessenen rechtlichen Losung zuzufuhren.
