The thesis proposal is looking at Policing in Society , how Police abuse their authority , Law Enforcement, the powers and responsibilities which go wrong. Covering a NSW Police Arrest and the ramifications of an arrest at home, on a second occasion constituting in legal terms "Double Jeopardy". Investigating "Double jeopardy" and legal recourse of civil action.
The consequences of such Police action, Property Law ; trespass to land, trespass to personal property , trespass to person, police assault, and police imprisonment/detainment. The court and Police powers of leading charge cases.
Investigating Precedence , the case law available in common law and civil wrongs committed , the Torts of law , broken. The personal issues of civil liberties and legal rights, which were not adhered too, such as; Invasion of Privacy, Defamation , Slander & Liable, Negligence, Defences to Trespass, Interferences with Persons and Privacy, Duty of Care, Damage and remedies.The thesis will endeavour to discover any related philosophy or legal theory of what methods have been adopted or deployed in the post my arrest under NSW law , Federal law and overseas.
