English summary: The contributions to this volume analyze the delicate balance between the need for effective protection of intellectual property rights and the public interest in access to information and in free competition. From the perspective of constitutional law, economic theory, patent law, copyright law, trade mark law and competition law, the authors investigate whether the currently existing system of national, European and international intellectual property law adequately balances rights owners' interests and the public interest in a general access to information. German description: Dieser Band enthalt die Vortrage, die auf dem Eroffnungssymposium des Bayreuther DFG-Graduiertenkollegs Geistiges Eigentum und Gemeinfreiheit im Mai 2006 gehalten wurden. Die Autoren befassen sich aus verfassungsrechtlicher, okonomischer und zivilrechtlicher Perspektive mit dem Spannungsverhaltnis, das zwischen dem Interesse von Erfindern und Kreativen am effektiven Schutz ihres geistigen Eigentums und den Zugangsinteressen der Allgemeinheit besteht. Nach einer Einfuhrung, die wesentliche Gedanken des Symposiums zusammenfasst und in die aktuelle Diskussion einordnet, werden okonomische und verfassungsrechtliche Grundlagen untersucht. Uberlegt wird, ob das heutige Urheberrechtssystem noch zeitgemass ist und welche Perspektiven sich im europaischen Patentrecht abzeichnen. Das Verhaltnis zwischen Marken- und Lauterkeitsrecht bestimmen zwei Beitrage mit unterschiedlichen Akzenten. Inwieweit das internationale Recht des geistigen Eigentums einer Erganzung durch ein internationales Kartellrecht bedarf, wird abschliessend erortert.
