This release updates Nassau County Bar Association and New York County Lawyers' Association ethics opinions, featuring the full text of the new opinions.
NYCLA Opinion 738 provides that a lawyer who receives inadvertently sent metadata in opposing counsel's electronic documents is ethically obligated to avoid searching the metadata in those documents.
Bar Association of Nassau County Opinion No. 08-01 addresses the duty to report suspicion that opposing attorney may be proffering false evidence in litigation when the attorney acquires positive knowledge of the adversary attorney's complicity with a client's fraud, deceit or misrepresentation.
Bar Association of Nassau County Opinion No. 08-02 provides that a lawyer may enter into a non-exclusive reciprocal referral arrangement with a non-lawyer orthopedist as long as the attorney does not provide a monetary or other tangible benefit in exchange for the referral. The attorney may advance the orthopedist's fees for a medical report as well as expenses reasonably incurred by the orthopedist with respect to attending or testifying.
