English summary: For a long time, state actions have supported the pluralization of those ethical ways of living which are based on religion or ideologies. At the same time, they have also attempted to counterbalance this development in view of the framework of their own orientation, which saw itself as guided by reason and the law, meaning that it is neutral towards religion and ideologies. However, insight into the inevitable positionality of the human use of reason shows that the goal of bringing ideological-ethical pluralism under control against the backdrop of a higher uniform state ethos is unrealistic and dangerous. It is not beyond pluralism, but in it - completely exposed to its tension and its conflicts - that politics and the law have to look for a system of peaceful coexistence. Eilert Herms studies those conditions which would make it possible to find a solution for this task. German description: Seit der fruhen Neuzeit hat staatliches Handeln in Politik und Recht die Pluralisierung der religios bzw. weltanschaulich begrundeten ethischen Lebensorientierungen faktisch befordert. Gleichzeitig hat es diese Entwicklung im Horizont eines eigenen Orientierungsrahmens aufzufangen versucht, der sich selbst vernunftrechtlich und damit auch religios-weltanschaulich neutral verstand, d. h. zu allen besonderen religios-weltanschaulichen Einzelpositionen aquidistant und gleichzeitig ihnen allen uberlegen. Eine solche Bandigung des weltanschaulich-ethischen Pluralismus im Horizont eines ubergeordneten einheitlichen Staatsethos schwebt auch heute noch einigen Verantwortlichen als Ziel vor. Jedoch zeigt nicht nur die Erfahrung der faktisch wachsenden Pluralitat weltanschaulich-ethischer Orientierungen in der Gesellschaft, sondern auch die zunehmende Einsicht in die wesentliche und unausweichliche Positionalitat jedes moglichen menschlichen Vernunftgebrauchs, dass diese Zielsetzung unrealistisch und gefahrlich sein durfte. Alles Handeln in Politik und Recht bewegt sich nicht oberhalb des Kraftefeldes des weltanschaulich-ethischen Pluralismus, sondern in diesem Kraftefeld. Nicht oberhalb seiner, sondern in ihm - den Spannungen und Konflikten des Pluralismus uneingeschrankt ausgesetzt - mussen Politik und Recht nach einer zuverlassig friedensdienlichen Ordnung des Zusammenlebens suchen. In den Beitragen des vorliegenden Bandes untersucht Eilert Herms die Bedingungen, unter denen diese Aufgabe zu losen ware.
