Against this background, Jan Busche develops his concept of the general obligation to contract as a legal institution and as an integral part of the system of the law of contract. German description: Jan Busche stellt den Standort und die Bedeutung des Kontrahierungszwangs in der modernen Privatrechtsordnung dar. Er geht davon aus, dass die reale Grundlage der individuellen Selbstbestimmung, namlich die wirtschaftliche und intellektuelle Selbstbestimmungsfahigkeit des Individuums, vielfach gestort ist.
