More DescriptionThe volume provides an approach to South Asian constitutional systems from a different methodological perspective than traditional comparative analyses (often Eurocentric or, in any case, linked to the Western Legal Tradition). The work is developed in three parts: the first takes the comparatist "beyond the West", from the assumption that in comparative public law studies there are still numerous "gray areas", substantially unexplored territories, proposing innovative methodological paths to study the constitutional systems of South Asia. The second part is entirely devoted to India which, not only because of its size and geopolitical relevance, but above all because of its institutional characteristics, represents a significant example of "hybrid" constitutionalism and consolidated democracy. The third part analyzes the constitutional systems of Sri Lanka, Pakistan, Bangladesh, Nepal and Bhutan, constitutional experiences in the process of consolidation, young and largely incomplete democracies, which seek to respond to contemporary challenges with often original constitutional arrangements.
