With the use of evolutionary arguments in particular he attempts to show ways of making the present line of reasoning in competition law, which is still static, more dynamic. German description: Als Instrument der Oligopolkontrolle hat die Europaische Kommission die kollektive Marktbeherrschung eingefuhrt. Ist diese jedoch okonomisch hinreichend fundiert? Marc Amstutz zeigt, dass die Grundlagen des Wettbewerbsbeschrankungsrechts korrigiert werden mussen. Anhand der Neuen Industrieokonomie weist er nach, dass sich das Konzept der kollektiven Marktbeherrschung noch weitgehend nach dem statischen Denken der neoklassischen Okonomik richtet. Deshalb kann damit die Bildung von Oligopolmacht nicht mit der in der Praxis erforderlichen Zuverlassigkeit vorausgesagt werden. Marc Amstutz untersucht daraufhin die Vorzuge der evolutorischen Okonomik im Vergleich zur Neoklassik.
